Kinetic Asset Protection is the structuring of an asset protection program so that it automatically (and outside a client’s ability to control) changes to meet creditor threats as they or other contingencies arise. Kinetic Asset Protection is one of the most effective, cutting-edge strategies available.
For example, an offshore LLC could provide for a protector (which should never be the client, or an insider of the client), and language in the documentation would mandate that if certain contingencies arose (such as a lawsuit, IRS audit, divorce filing, etc.), the protector must automatically replace the manager with an offshore person, regardless of whether the current manager consents.
An offshore LLC could also disassociate any member from the company if the member was threatened by a lawsuit or attachment by certain ‘excluded persons’ as defined in its operating agreement. (Of course, this is only effective if you use a multi-member or DEMMLLC with at least one member being an offshore entity that would never be subject to creditor attack.)
